Summary

Allows the Secretary to let a State or local government do the federal environmental reviews and decisions instead of the federal agency. The Secretary must make rules for how this works and talk with the Council on Environmental Quality. The rules will say which programs are included. A public housing agency must ask for this help and give a certification at least 15 days before the Secretary approves or before any money is promised. The certification must be in a form the Secretary accepts, signed by the State’s or local government’s chief official or a qualified officer, say the State or local government did all the required review work, and say the signing officer agrees to act as the federal responsible official under NEPA and accepts federal court jurisdiction to enforce those duties. If a local government handles the work, the Secretary can let the State carry out the Secretary’s steps and count that as meeting the Secretary’s duties.
