The Secretary of Housing and Urban Development may manage, operate, insure, and otherwise handle any property acquired or built under subchapters II to VII of this chapter. The Secretary can use government staff, selected private agencies, or public agencies. HUD may pursue claims to final collection, including by compromise. The Secretary can rent, lease, exchange, sell for cash or credit, or transfer all or part of the property, and may give parts free to local municipalities, including the District of Columbia, for streets or other public use. Transactions must use terms the Secretary considers in the public interest. The Secretary must set fair rents based on value and, during an emergency, may in special cases adjust rent to match tenants’ incomes. Rents for Army, Air Force, and Navy personnel are set by those Departments. Leases under this authority are not subject to section 1302 of title 40.
