The Secretary of Defense or someone he picks can hire qualified builders to quickly build housing on U.S. land or leased land near military bases so service members have places to live. Each contract must give the Secretary control of each unit once HUD says it is ready to occupy. The contract must also transfer the mortgagor’s corporate stock (except any stock held by HUD) to the Secretary when HUD says the project is finished. Contracts must include terms the Secretary thinks are needed to protect the United States, and must require performance and payment bonds acceptable to the Secretary. Those bonds count as meeting the bond rules in section 3131 of title 40. The Secretary must invite competitive bids and advertise as required in chapters 221 and 241 of title 10. Eligible bidder means a person, partnership, firm, or corporation that the Secretary, after consulting HUD, finds has the right experience and financial responsibility and submitted the lowest acceptable bid. The Secretary may buy mortgagor stock for properties with mortgages insured under Title VIII of the National Housing Act (amended in 1955), act as owner during the mortgage, dissolve the corporation when the mortgage ends, guarantee or pay notes, and protect the Armed Services Housing Mortgage Insurance Fund. The Attorney General must give a written opinion on title when asked. If title is good, the Secretary may guarantee the mortgagee against title claims. Mortgage loan proceeds may not be used for title search or title insurance costs unless the Secretary says it is necessary; then he may pay reasonable costs from the revolving fund under section 1594a(g), must record the decision in writing, and must promptly tell the Armed Services Committees and report the amount paid.
