When a federal agency, as defined by the OMB Director after consulting the HHS Secretary, builds, buys, or upgrades health IT that sends identifiable health data to other agencies or to non‑federal groups, it must use systems and products that meet the standards adopted under section 300jj–14 whenever those standards are available. The President must make sure federal programs that collect and send large amounts of health information follow those standards within three years after the standards are adopted.
