If an organization sends protected health information to a covered entity and needs regular access to that data, it must sign written agreements that meet 45 C.F.R. 164.502(e)(2) and 164.308(b). Examples include HIEs, RHIOs, e‑prescribing gateways, and vendors that provide personal health records. Those organizations will be treated as the covered entity’s business associate under part 164, subparts C and E, as of February 17, 2009.
