The law says people who qualify and enroll in a silver-level health plan through the marketplace get help lowering their out-of-pocket costs. The federal government tells the insurer who is eligible, and the insurer must cut the person’s cost-sharing the way the law requires. An "eligible insured" is someone in a silver plan from the marketplace with household income over 100% but at most 400% of the federal poverty level. Out-of-pocket limits are cut first: by two-thirds for incomes over 100% up to 200% of poverty, by one-half for incomes over 200% up to 300%, and by one-third for incomes over 300% up to 400%. The plan’s share of total allowed costs is increased to set levels by income: 94% for 100–150% of poverty, 87% for 150–200%, 73% for 200–250%, and 70% for 250–400%. The government will adjust limits if needed and will pay insurers the value of these reductions. Extra benefits beyond required essential health benefits are not covered by these reductions, and reductions do not apply to pediatric dental if that benefit is in a separate plan. Special rules: American Indians with income up to 300% of poverty are treated as eligible and must have no cost-sharing; services directly provided by Indian Health Service or Tribal providers have no cost-sharing and those providers must not be paid less because of it. People not lawfully present cannot get these reductions. The government will set simple rules for counting family size and income. For people who got unemployment pay in 2021, their income is treated as meeting the rule and is capped at 133% of poverty for applying these reductions.
