Agency heads and the Secretary of Defense must, working with the Secretary of Commerce, create policies to grow U.S. production of technologies made by the Manufacturing USA Network. The policies must help domestic developers link with U.S. manufacturers and financiers; encourage moving intellectual property and products to U.S. makers; help with supplier scouting and supply‑chain development, including using the Hollings Manufacturing Extension Partnership under section 278k of title 15; set a review process for foreign‑owned members (especially countries of concern like the People’s Republic of China); and, when appropriate, prefer Federal buying from U.S. sources. The rules must allow case‑by‑case waivers for reasons like cost, availability, mission needs, emergencies, legal or treaty obligations, or other important factors. A company of the People’s Republic of China may not join without such a waiver. The term “company” is defined in section 847(a) of the National Defense Authorization Act for Fiscal Year 2020 (Public Law 116–92; 10 U.S.C. 4819 note). The Secretary must get advice from the United States Manufacturing Council of the International Trade Administration on investment and workforce support for the Manufacturing USA Program.
