Defines four key words used for rules about federally funded research. A "covered individual" is someone who makes a meaningful scientific contribution to a federally funded research project and is officially named as such by the federal agency that funds the work. A "foreign country of concern" is the People’s Republic of China, the Democratic People’s Republic of Korea, the Russian Federation, the Islamic Republic of Iran, or any other country the Secretary of State calls a country of concern. A "foreign entity of concern" is a foreign group that meets one of several conditions, for example being named a foreign terrorist organization under section 1189(a) of title 8, listed on the Treasury Department’s specially designated nationals and blocked persons (SDN) list, owned or controlled by a government of a covered nation (see 10 U.S.C. 4872), alleged by the Attorney General in connection with convictions under statutes like chapter 37 of title 18 (the Espionage Act), sections 951 or 1030 of title 18, chapter 90 of title 18 (the Economic Espionage Act of 1996), the Arms Export Control Act (22 U.S.C. 2751 et seq.), sections 2274, 2275, 2276, 2277, or 2284 of this title, the Export Control Reform Act of 2018 (50 U.S.C. 4801 et seq.), or the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.), or being found by the Secretary of Commerce (with the Secretary of Defense and the Director of National Intelligence) to be engaged in unauthorized activity harmful to U.S. national security or foreign policy. A "malign foreign talent recruitment program" is any program or offer of money or valuable benefits from a foreign country or an affiliated group that aims to get a researcher to do things that interfere with a U.S. research award (for example, steal intellectual property, recruit others, take undisclosed foreign jobs, block work on the federal award, hide participation, or create conflicts of interest), and includes programs sponsored by a foreign country of concern, an academic institution on the list at section 1286(c)(8) of the John S. McCain NDAA for FY2019 (10 U.S.C. 2358 note; Public Law 115–232), or a program on the list at section 1286(c)(9) of that Act.
