The Army, through the Chief of Engineers, can create wetlands as part of a water project when doing required dredging. They may do this only if the Chief finds the environmental, economic, and social gains justify the extra cost, the added cost will not exceed $400,000, and there is reasonable evidence the wetland won’t be largely lost by natural or man-made causes. Reports to Congress after October 22, 1976 must consider wetlands when appropriate. For project accounting, wetland benefits count at least equal to their cost, and the United States pays all establishment costs.
