Title 42 › Chapter CHAPTER 21— - CIVIL RIGHTS › Subchapter SUBCHAPTER I— - GENERALLY › § 1986
If someone knows a wrong listed in section 1985 is about to happen and can stop it or help stop it but refuses or neglects to act, that person must pay for the harm that their failure allowed, so far as the harm could have been avoided with reasonable effort. Any number of people who failed to act can be sued together in a civil lawsuit. If the wrongful act causes a death, the deceased’s legal representatives can sue and recover up to $5,000 for the widow, or if there is no widow, for the next of kin. The lawsuit must be started within one year after the cause of action begins.
