Defines key words used in the subchapter. "Institution" means a facility the State owns, runs, manages, or uses to provide services that is for people who are mentally ill, disabled, mentally retarded, chronically ill, or handicapped; or a jail, prison, pretrial detention center, certain juvenile placements, or places that provide skilled nursing, intermediate or long-term, custodial, or residential care. Privately owned facilities are not "institutions" if the only connection to the State is state licensing, receiving payments under title XVI or XVIII, or under a State plan approved under title XIX, or both. "Person" means an individual, trust or estate, partnership, association, or corporation. "State" includes any State, the District of Columbia, Puerto Rico, and U.S. territories and possessions. "Legislative days" are any calendar day when either House of Congress is in session.
