§2000gg–3 Rulemaking

Title 42 › Chapter CHAPTER 21G— - PREGNANT WORKER FAIRNESS › § 2000gg–3

Last updated Apr 6, 2026|Official source

Summary

The Commission must write rules in an accessible format within 1 year after December 29, 2022 (by December 29, 2023). The rules must follow the usual federal rulemaking steps and must give examples of reasonable accommodations for known limits tied to pregnancy, childbirth, or related medical conditions. Within 6 months after the Commission issues those rules, the Board (as defined elsewhere in the law) must issue rules to apply the law to the employees covered by it. The Board’s rules should match the Commission’s rules, but the Board may change them if it gives a clear, stated reason showing the change would better protect rights or make the rules work.
