Summary

The Commission must run and coordinate its work on licenses for bringing nuclear reactors and radioactive materials into or out of the country. It must also work with other countries to help regulate nuclear reactors and radioactive materials, including with members of the Organisation for Economic Co-operation and Development (OECD) and the Nuclear Energy Agency. The Commission must help other U.S. agencies and foreign partners use international technical standards for licensing and regulation, help countries build strong nuclear regulatory agencies and laws, and run exchange programs and training with the Secretary of State to improve civil nuclear licensing and oversight. For those exchange programs, the Commission must coordinate with the Secretary of Energy, the Secretary of State, the National Laboratories, the private sector, and colleges and universities. The Commission may create an “International Nuclear Export and Innovation Branch” inside its Office of International Programs to do this work. It must also coordinate all international activities under this authority with the Secretary of State, the Secretary of Energy, and other relevant agencies. Nothing here changes the Commission’s power to license and regulate the civilian use of radioactive materials.

(a)(1)The Commission shall—
(A)coordinate all work of the Commission relating to—
(i)import and export licensing for nuclear reactors and radioactive materials; and
(ii)international regulatory cooperation and assistance relating to nuclear reactors and radioactive materials, including with countries that are members of—
(I)the Organisation for Economic Co-operation and Development; or
(II)the Nuclear Energy Agency; and
(B)support interagency and international coordination with respect to—
(i)the consideration of international technical standards to establish the licensing and regulatory basis to assist the design, construction, and operation of nuclear reactors and use of radioactive materials;
(ii)efforts to help build competent nuclear regulatory organizations and legal frameworks in foreign countries that are seeking to develop civil nuclear industries; and
(iii)exchange programs and training provided, in coordination with the Secretary of State, to foreign countries relating to civil nuclear licensing and oversight to improve the regulation of nuclear reactors and radioactive materials, in accordance with paragraph (2).
(2)With respect to the exchange programs and training described in paragraph (1)(B)(iii), the Commission shall coordinate, as applicable, with—
(A)the Secretary of Energy;
(B)the Secretary of State;
(C)the National Laboratories;
(D)the private sector; and
(E)institutions of higher education.
(b)The Commission may establish within the Office of International Programs a branch, to be known as the “International Nuclear Export and Innovation Branch”, to carry out the international nuclear export and innovation activities described in subsection (a) as the Commission determines to be appropriate and within the mission of the Commission.
(c)
(d)The Commission shall coordinate all international activities under this section with the Secretary of State, the Secretary of Energy, and other applicable agencies, as appropriate.
(e)Nothing in this section alters the authority of the Commission to license and regulate the civilian use of radioactive materials.
