The Commission can let people it already authorized under section 2165(b) and (c) give Restricted Data to employees of the Department of Defense, DoD contractors, or members of the Armed Forces when they need the data to do their jobs. The DoD agency head or their designee must certify that the person needs the data. The DoD agency head must also decide, using the agency’s security rules, that giving access will not harm national defense and security. The Secretary of Defense must find the agency’s security and personnel rules adequate and reasonably similar to the Commission’s standards under section 2165.
