If the Commission shares Restricted Data from a foreign patent application with another country, the United States must pay the patent owner fair compensation. The Commission sets the amount; the owner gets 75% of that amount and can sue the United States in federal court where they live under 28 U.S.C. §1346 to recover the remainder.
