The Commission can cancel a license if the applicant lied on the application, if information from the application, inspections, or records shows problems that would have caused denial, if the holder failed to build or run the facility as allowed, or if the holder broke any rules. When it cancels a license, the Commission must follow the procedures in section 558(c) of title 5. After revocation, the Commission may immediately take back any special nuclear material the licensee holds. If the matter is critical to national defense, security, or public health and safety, the Commission may seize material or enter and operate the facility before the usual procedures in subchapter II of chapter 5 and chapter 7 of title 5 begin. The licensee must receive just compensation for use of the facility.
