Require the Board to send the Secretary a written draft of any recommendation and the data behind it at least 30 days before the Board files the final recommendation. The Secretary has 30 days after getting the draft to send written comments and can ask the Board for more time. After that comment period ends, the Board can send its final recommendation. Once the Secretary gets the final recommendation, the Board must quickly put the recommendation and any Secretary letters where the public can see them (in DOE reading rooms and in the Federal Register) and ask for public comment for 30 days. The Secretary must reply in writing within 45 days after that Federal Register notice (the Board may allow up to 45 more days). The reply must say what parts the Secretary accepts or rejects, what actions will be taken, and why. The Secretary then publishes that reply and asks for 30 days of public comment. The Board gets all public comments and can hold hearings. If the Secretary rejects any part, the Board must either stick with or change its recommendation and tell the Secretary. Then the Secretary has 30 days to make a final decision and publish it and report the decision and reasons to the congressional committees named in the law. For accepted recommendations, the Secretary must send an implementation plan to the Board within 90 days (or get a 45‑day extension with notice to the committees) and finish work within one year or explain delays to the committees. If work is impractical because of budget or meeting nuclear stockpile needs, the Secretary must report that to the President and the committees. For urgent public‑health or safety threats, the Board also sends the recommendation to the President (and for info to the Secretary of Defense) and the President makes the final decision. Classified information and other DOE rules that limit release do not have to be made public.
