The Nuclear Regulatory Commission (NRC) must make rules within 2 years after October 24, 1992, to protect public health, safety, and national security at the Department’s gaseous diffusion uranium enrichment facilities. The rules must include adequate safeguards as described in section 2167. When the NRC issues a certificate of compliance, it must report to Congress, after talking with the Department and the Environmental Protection Agency (EPA), about health, safety, and environmental conditions and say whether the facilities meet those rules and other laws. The NRC must also run a certification process to check the Corporation follows the rules. The Corporation must apply for a certificate at least every 5 years. A certificate replaces any license for facilities the Corporation leases. The NRC, with the EPA, will review operations and must have ready access to facilities, staff, and information. The Department, the Corporation, and any contractor must cooperate. The Corporation may not operate leased facilities unless the NRC (with the EPA) finds them in compliance or approves a plan to reach compliance.
