A utility may be transferred if the new owner is legally allowed to take and run it. The transfer can go to the city where the community is, the state, a local government agency, or a person, company, or other legal entity. When choosing who gets the utility, the Commission can look at who normally owns similar utilities in the state; whether the buyer can run it; the likely sale price and the buyer’s ability to pay and handle costs; what the community’s eligible voters want in official or Commission-set votes; and whether the transfer lessens the United States’ need to provide local assistance under subchapters VII and VIII.
