The government can give local public buildings and places (like schools, hospitals, or cemeteries) to certain groups if those groups are legally allowed to take them. These groups can include the city where the community is, the State, a part of that State such as a county or agency, or a private nonprofit for a hospital or cemetery. When deciding which group gets a school, hospital, or other local building, the Commission must follow this order. First, use the result of any vote on the transfer that happened when the city was formed. Second, use the result of any referendum or other official vote on the proposed transfer. Third, if only one group can legally accept the property, pick that group. Finally, if none of those apply, the Commission will hold a vote of the community’s eligible voters using rules it sets.
