The Secretary must quickly create a rule that lists side effects (injuries, illnesses, disabilities, conditions, and deaths) that will be treated as caused by a smallpox vaccine or exposure to it. The list must also say how soon after vaccination each side effect must start for that presumption to apply. The Secretary can change the list by rule. A change starts on the day the final rule is issued and applies to claims filed that day or later and to claims already pending. If the change makes someone newly eligible, that person must file or update their claim within one year after the rule date if they got the vaccine, or within two years if the claim is for an accidental vaccinia inoculation.
