Title 42 › Chapter CHAPTER 6A— - PUBLIC HEALTH SERVICE › Subchapter SUBCHAPTER II— - GENERAL POWERS AND DUTIES › Part Part B— - Federal-State Cooperation › § 244d
The Secretary can give grants to local school agencies so public elementary and secondary schools can get AEDs and CPR training for students and staff. Grant money can be used to make program materials, run CPR and AED training for students, staff, and sports volunteers, create a school cardiac emergency plan, buy AEDs that are approved or cleared under 21 U.S.C. sections 360e, 360(k), or 360c(f)(2), buy needed batteries and do AED maintenance as the device label says, and replace old AED or CPR equipment and teaching materials. To get a grant, an applicant must be a local educational agency (including charter schools that are LEAs) working with a qualified health care entity and must apply to the Secretary as requested. “Elementary school,” “secondary school,” and “local educational agency” have the meanings in 20 U.S.C. 7801. A “qualified health care entity” is a public body or a tax‑exempt organization under 26 U.S.C. 501(c)/501(a) that can develop, train, implement, and give technical help on AED and CPR programs.
