Within 2 years after November 21, 2013, the Secretary of Health and Human Services must write and publish rules for doing research that transplants organs infected with HIV into people who already have HIV. If needed to allow that research, the national organ-sharing network (the Organ Procurement and Transplantation Network) must update its quality standards, and the Secretary must update federal regulation 42 CFR 121.6, all within the same 2-year time frame. Within 4 years after November 21, 2013, and then every year, the Secretary must review research results with the organ network to decide if the standards should change about HIV-infected donor organs or about putting an organ with one HIV strain into a person with a different strain. If changes are needed, the Secretary must direct the network to revise the standards in a way that does not reduce transplant safety and must update 42 CFR 121.6 to match.
