§280c–5 General provisions

Summary

The Secretary cannot award a grant or cooperative agreement under this part unless the recipient agrees to spend no more than 5% of the award on administrative costs. For grants, the applicant must send an application that explains how the money will be spent, gives assurances that it will follow the rules the Secretary requires, and includes any other information or forms the Secretary asks for. The Secretary must evaluate the activities paid for by these awards and, within 1 year after finishing those evaluations, send a report of the findings to Congress. The terms "Indian tribe" and "tribal organization" mean what section 1603 of title 25 defines. The law authorizes $20,000,000 for each fiscal year 2020 through 2024 and $33,000,000 for each fiscal year 2025 through 2029.

(a)The Secretary may not make a grant or cooperative agreement under section 11 So in original. Probably should be “section”. 280c–3 or 280c–4 of this title to an entity unless the entity agrees that not more than 5 percent of the grant or cooperative agreement will be expended for administrative expenses with respect to the grant or cooperative agreement.

(b)The Secretary may not make a grant under section 1 280c–3 or 280c–4 of this title to an entity unless the entity has submitted to the Secretary an application for the grant. The application shall—

(1)contain the description of intended expenditures;

(2)with respect to carrying out the purpose for which the grant is to be made, provide assurances of compliance satisfactory to the Secretary; and

(3)otherwise be in such form, be made in such manner, and contain such information and agreements as the Secretary determines to be necessary to carry out this subpart.

(c)The Secretary shall—

(1)provide for an evaluation of the activities for which an award is made under section 1 280c–3 or 280c–4 of this title; and

(2)not later than 1 year after the completion of such evaluations, submit to the Congress a report describing the findings made as a result of the evaluations.

(d)In this subpart, the terms “Indian tribe” and “tribal organization” have the meanings given such terms in section 1603 of title 25.

(e)For the purpose of carrying out this subpart, there are authorized to be appropriated $20,000,000 for each of fiscal years 2020 through 2024 and $33,000,000 for each of fiscal years 2025 through 2029.
