The Secretary of Health and Human Services must create a grant program to give money to school-based health centers or their sponsoring facilities to help them operate. To get a grant, an applicant must be a school-based health center or its sponsor and must apply when and how the Secretary requires. The application must promise that the grant money will not pay for any services that federal, state, or local law does not allow. The Secretary must prefer centers that serve many children eligible for medical assistance under the State Medicaid plan (Title XIX) or for child health assistance under Title XXI, including Medicaid waivers. Grant money may only be used for buildings, land, equipment, or similar capital expenses as the Secretary specifies. Funds cannot be used for staff salaries or to deliver health services. For each of fiscal years 2010 through 2013, $50,000,000 is provided for this purpose and stays available until spent. The terms "school-based health center" and "sponsoring facility" are defined in section 2110(c)(9) of the Social Security Act.
