The Secretary must not approve or pay for any research application that needs review by an Institutional Review Board unless that board reviewed it and a majority recommended approval. For NIH clinical research, the Secretary must not allow the work to go forward unless it was approved under the NIH human subjects protection procedures. For NIH proposals that require scientific peer review, the proposal must be recommended by a majority of the reviewers and also by a majority of the appropriate advisory council before the Secretary can approve or fund it. Once research has those approvals, the Secretary cannot refuse to give the money just because of ethical concerns unless an ethics advisory board is set up to study the issue. The Secretary must publish a Federal Register notice and wait 30 days before picking members. The ethics board must have 14–20 non-government members, including at least one attorney, one ethicist, one practicing physician, one theologian, and between one-third and one-half scientists with strong research records. The board must hold inquiries and public hearings, get needed HHS information, and report within 180 days to the Secretary and to the House Committee on Energy and Commerce and the Senate Committee on Labor and Human Resources with its findings and a recommendation about withholding funds. The Secretary may only withhold funds if the board’s majority recommends it, or if the board recommends not to withhold but the Secretary finds that recommendation arbitrary and capricious. The Secretary can still deny funding for poor qualifications of those doing the work (review findings on qualifications are final) or because of funding priorities. Board members are paid up to the GS–18 basic pay rate and the board ends 30 days after its report. “Ethical considerations” means whether the research itself is unethical to do or support.
