Summary

Create and run a national advisory council called the National Advisory Council on Nurse Education and Practice. The Secretary must appoint 21 to 23 people who are not federal employees. Of those appointees, 2 must be full-time nursing students, 2 must be members of the general public, 2 must be practicing professional nurses, and 9 must be leading authorities or representatives from nursing education, advanced practice nursing, hospitals, or other nursing organizations. The Secretary (or the Secretary’s delegate) is a nonvoting ex officio member and will serve as chair. Appointments had to begin no later than 90 days after November 13, 1998, and each member serves a 4-year term. The Secretary must make sure members are balanced across nursing fields, geography, urban and rural areas, and that minorities are adequately represented. Most members must be nurses. Vacancies are filled the same way as the original appointment and last only for the unexpired term. The Council must give advice to the Secretary and to Congress about nurse workforce, education, and practice improvements. It must report its activities, findings, and recommendations not later than 2 years after March 27, 2020, and every year after that to the Secretary, the Senate Committee on Health, Education, Labor, and Pensions, and the House Committee on Energy and Commerce. The Council must meet at least twice a year, share an agenda at least 14 days before meetings, give materials at meetings, and post a meeting summary within 30 days. Members are paid each day they work at the daily rate equal to the Executive Schedule Level IV annual pay (5 U.S.C. 5315), get travel expenses like federal employees, and federal officers who serve on the Council get no extra pay. Money appropriated for parts B, C, and D may be used to support the Council. Chapter 10 of title 5 applies only if it does not conflict with these rules.
