Defines key words used in this subchapter. Average means the total hours of Native language instruction given to all students in a language-immersion program during a school year divided by the number of students in that program. Financial assistance means help given by grants, agreements, or contracts, but not buying equipment, goods, or services. Indian reservation or Alaska Native village means reservations or tribal communities of federally or State-recognized tribes (including former Oklahoma reservations), tribal lands with allotments or sale limits, and lands of Alaska Native villages, including those selected under the Alaska Native Claims Settlement Act (43 U.S.C. 1601 et seq.). Native Hawaiian means someone whose ancestors lived in the Hawaiian Islands before 1778. Rule has the meaning in 5 U.S.C. 551(4). Secretary means the Secretary of Health and Human Services. Native American Pacific Islander means a person indigenous to a U.S. Pacific territory or possession, including when living in the United States.
