Title 42 › Chapter CHAPTER 6A— - PUBLIC HEALTH SERVICE › Subchapter SUBCHAPTER XIX— - VACCINES › Part Part 2— - National Vaccine Injury Compensation Program › Subpart subpart d— - general provisions › § 300aa–34
The Secretary must check how many compensation awards were given to people who filed claims under section 300aa–11 for vaccine-related injuries or deaths from vaccines given on or after December 22, 1987. The first check covers the 12 months that start on December 22, 1987. After that, the Secretary must check every 3 months. If a check shows the total number of awards accepted under section 300aa–21(a) by the end of the period is higher than the limit for that period, the Secretary must tell Congress. Then, 180 days after Congress gets that notice, no new petitions under section 300aa–11 may be filed for injuries or deaths from vaccines given on or after December 22, 1987. The limits are: 12 months after Dec. 22, 1987 — 150; months 13–15 — 188; 16–18 — 225; 19–21 — 263; 22–24 — 300; 25–27 — 338; 28–30 — 375; 31–33 — 413; 34–36 — 450; 37–39 — 488; 40–42 — 525; 43–45 — 563; 46–48 — 600.
