The Secretary can make a State pay back money it got under section 300ee–11(a) if the Secretary finds the State did not spend the money the way it promised in its application under section 300ee–13. If the State does not repay, the Secretary can take the amount out of future payments under section 300ee–11(a). The Secretary can also hold up future payments for the same reason, but must stop if there are reasonable assurances the State will follow the agreements and cannot hold up funds for a minor mistake. Before forcing repayment or stopping payments, the State must be given a chance for a hearing in the State. The Secretary must quickly respond to serious complaints about misuse. Each year the Secretary will investigate spending in several States to check compliance, and the Comptroller General may also investigate. States and any entities that got the money must make their books and records available to the Secretary and the Comptroller General or their authorized agents for review and copying when reasonably requested. Investigators may not ask for information that is not readily available or make unreasonable requests for special collection or formats, except when data are gathered in a court case.
