The Secretary must only approve a loan guarantee if the loan’s terms protect the United States’ money and are reasonable, and if the loan would not be available on fair terms without the guarantee. The Secretary also must be satisfied the borrower can pay principal and interest when due and has enough extra money to finish the project. The government can recover any guarantee payments it makes and then step into the borrower’s rights to collect what’s owed. Guarantees generally cannot be attacked later except for fraud. The Secretary can change guarantee or loan terms to protect the United States and, for good cause, can waive recovery rights (but a sale with a guarantee stays guaranteed). The Secretary may sell loans on the private market, to the Federal National Mortgage Association, or to the Federal Financing Bank for about the unpaid principal. The Secretary can agree to guarantee payments to the buyer and pay an interest subsidy so the loan yields a reasonable rate. Sale agreements can let the Secretary collect payments, repurchase the loan, close out defaults by paying the outstanding amount, and then seek repayment from the borrower. Money from sales goes into a Treasury loan and loan guarantee fund that is available without fiscal year limit and as appropriated to make loans, back guarantees, pay interest subsidies, repurchase loans, and carry out default-prevention actions. Assets from an earlier fund are moved into this fund, and additional appropriations were authorized for fiscal years ending June 30, 1975; June 30, 1976; and September 30 of 1977, 1978, 1979, 1980, 1981, and 1982. The Secretary may also act to prevent defaults by waiving conditions, deferring or renegotiating payments, temporarily paying interest or principal, funding technical help, and, consistent with state law, selling or holding pledged property to protect the United States’ interests.
