The Assistant Secretary can pay back a State or a tribal organization that has a subchapter X grant when that State gives money to its area agencies on aging to provide support services and supplies during a President-declared major disaster under the Stafford Act. States or tribal groups must apply. All reimbursements in a fiscal year cannot be more than 2 percent of the money available for carrying out subchapter IV. If the Assistant Secretary decides within 5 days after the disaster is declared to reimburse, at least 75 percent of that amount must be paid within 5 days of the decision. At the start of each fiscal year the Assistant Secretary must set aside an amount equal to 2 percent of the funds for subchapter IV for these reimbursements. Any set-aside not obligated by the end of the third quarter must be returned to use under subchapter IV. States and tribal organizations may still spend more on disaster relief for older people using other federal, state, or private funds.
