The Commissioner of Social Security must, if an Indian tribe asks, make an agreement to put tribal council members’ work under the Social Security system. The agreement covers every council member and all services they do as council members. For Social Security rules, those services count as "employment" under this subchapter, despite section 410(a). "Member" means someone elected or appointed to serve on or lead the tribal council. "Tribal council" means the tribe’s elected or appointed governing body. The agreement starts on a date the parties pick, but not earlier than the first day of the next calendar month after both sign. At the tribe’s request, the agreement can cover earlier services if the tribe timely paid to the Secretary of the Treasury amounts equal to the taxes under sections 3101 and 3111 of the Internal Revenue Code of 1986 (chapter 21). The agreement cannot require payments after its start date for taxes on earlier work, and it cannot be ended once it is in effect.
