§6991a Notification

Title 42 › Chapter CHAPTER 82— - SOLID WASTE DISPOSAL › Subchapter SUBCHAPTER IX— - REGULATION OF UNDERGROUND STORAGE TANKS › § 6991a

Last updated Apr 6, 2026|Official source

Summary

Owners must tell the state or local agency if they have an underground storage tank. They must do this within 18 months after November 8, 1984, and say the tank’s age, size, type, where it is, and how it is used. Tanks taken out of use after January 1, 1974 must also be reported within that 18 months unless the owner knows the tank was removed later; tanks taken out on or before January 1, 1974 do not need to be reported. For tanks taken out of use, the owner must give the date taken out, the tank’s age then, size/type/location, and what and how much was left inside. Any tank put into use after the first reporting period must be reported within 30 days. Starting 30 days after the federal form is created, people who put regulated substances into tanks must warn owners about these reporting duties for 18 months. Starting 30 days after new tank standards are issued, sellers must tell buyers about the reporting duty. Governors had 180 days after November 8, 1984 to pick which state or local offices get the reports. The federal Administrator had 12 months after November 8, 1984 to make the official report form, after getting public comment and consulting States. Each State must make two lists of tanks (one for petroleum, one for other regulated substances) using the reports and send the combined data to the Administrator by 270 days after October 17, 1986. States that get federal funds must keep a public record, update it at least once a year, and include yearly data on releases (number, sources, causes), compliance with the program, and equipment failures.
