§7136 Economic Regulatory Administration; appointment of Administrator; compensation; qualifications; functions

Summary

Creates an Economic Regulatory Administration inside the Department. It is led by an Administrator who the President picks and the Senate approves. The Administrator is paid at the rate for Level IV of the Executive Schedule under section 5315 of title 5. The Administrator must have proven ability, background, training, or experience to fairly judge the needs of all people affected by federal energy policy. The Secretary must make rules that keep the Administration’s regulatory work separate from its enforcement work. Under subchapter IV, the Secretary may use the Administration to carry out whatever functions he considers appropriate.
