Summary

The Administrator must ask the Attorney General to represent him in any civil lawsuit under this chapter where the Administrator is a party. If the Attorney General does not say within a reasonable time that he will take the case, lawyers chosen by the Administrator must handle it. If the Attorney General agrees to represent the Administrator, the Department of Justice’s work will follow the June 13, 1977 memorandum of understanding with the Environmental Protection Agency and will include the Administrator’s appointed lawyers as that memorandum allows.
