The Administrator must write rules, after giving notice and a chance for public comment, to speed up the phase-out of producing and consuming class I and class II substances (and the use of class II substances) if one of three things is true. First, current credible science (including Montreal Protocol reports) shows the substance may harm the stratospheric ozone layer enough to need faster action to protect people and the environment. Second, workable substitutes exist so a faster schedule is practical, considering technology, safety, and other factors. Third, the Montreal Protocol itself is changed to require faster cuts. Any person can ask the Administrator to make these rules. The Administrator must approve or deny the request within 180 days. If denied, the Administrator must publish an explanation. If approved, final rules must be issued within 1 year. Petitions must include enough data to support them. If the information is not enough, the Administrator must use any authority they have under laws they run to get the needed information.
