Title 42 › Chapter CHAPTER 88— - URANIUM MILL TAILINGS RADIATION CONTROL › Subchapter SUBCHAPTER I— - REMEDIAL ACTION PROGRAM › § 7920
The Secretary can fine a person up to $1,000 per day for breaking rules or agreements about specific processing sites, disposition sites, or remedial actions. Before a fine is set, the person must get notice and a chance for a public hearing under section 554 of title 5. A person can ask the United States Court of Appeals for review within 60 calendar days after the Secretary’s order. The court can confirm, change, cancel, or send the case back to the Secretary. If a fine becomes final and unpaid, the Secretary can sue in any U.S. district court to collect it, and the court may not re-review the final fine. The United States, any State or local government, and their officials or employees cannot be fined. The Secretary can also seek court orders to stop violations or use other equitable remedies. Licensing rules under the Atomic Energy Act of 1954 are not covered here. Those licensing rules are enforced by the Commission as that Act says.
