States, local governments, public utilities, and people who enter contracts under plans approved under section 8235a(a) must keep records and file reports that the Secretary requires. The Secretary and the Comptroller General may inspect those books, papers, and reports at reasonable times and under reasonable conditions if the Secretary decides they are relevant. The Secretary must send a yearly report to the President, to be included with the Department of Energy’s annual report under section 7267, and then sent to Congress. The report must include (1) an estimate of the total energy saved by these activities, (2) an estimate of annual energy savings expected from each prototype residential energy efficiency program created under section 8235a(a) plans, (3) an analysis, done with the Federal Trade Commission and the Department of Justice, of how each prototype affects competition, and (4) if the Secretary thinks it useful, an analysis of what would happen and how it could be done to expand approval and financial support for these prototype programs nationwide.
