Agency heads can agree to change the agreed factors and data. All federal agencies must use those agreed factors and data when they set or revise energy conservation standards, except in three cases: (1) the Secretary of Energy approves different factors because they are critical to a program’s special needs; (2) using the agreed factors would break another law; or (3) a statute or legal duty requires changing the agreed factors.
