When the regular day for delivering benefit checks under subchapters II, VIII, or XVI falls on a Saturday, Sunday, or a legal public holiday (as defined in section 6103 of title 5), the checks must be mailed to arrive on the first earlier day that is not a Saturday, Sunday, or legal public holiday, even if that means they are sent before the month ends. If getting a check early causes someone to receive more than the correct amount for that month, no action will be taken to recover the extra under section 404 or 1383(b) or otherwise. For calculating the "OASDI trust fund ratio" under section 401(l), the "OASDI fund ratio" under section 415(i), and the "balance ratio" under section 910(b), checks mailed early under the rule above are treated as if they were delivered on the regular payment date.
