Require the head of the department that runs the Coast Guard to make and enforce rules, under international law, for ocean thermal energy conversion facilities and plantships. The rules must cover safety of people and property, stopping and cleaning up pollution, vessel movement and cargo transfers, anchor areas and markings, maintenance and law enforcement, and needed equipment and training. The head must also set rules for lights, warnings, and other safety gear. If a facility owner fails to mark parts as required, the department will mark them and charge the owner. Require that the department head, after consulting Commerce, Interior, State, and Defense, set safety zones around these facilities and plantships and say what activities are allowed there. The zones must be set no later than 30 days after the notice published under section 9112(d). Safety zones can also be made for construction periods. Owners may not let foreign-flag ships use the facility unless the foreign country agrees to U.S. jurisdiction in the zone and the ship’s owner names a U.S. agent for legal claims, except for force majeure. Within 1 year after August 3, 1980, the department must issue rules about documentation, design, construction, repair, inspection, certification, and crewing. Those rules must require documentation, minimum standards, and U.S. citizen or lawful permanent resident crews unless not enough qualified U.S. people exist or the President says it hurts national interest. Facilities that are documented count as U.S. vessels for the Ship Mortgage Act, 1920. The law also requires rules to protect navigation near ships working on submarine power cables. Definitions: ocean thermal energy conversion facility — a facility with major parts located seaward of the highwater mark (not just intake or discharge pipes).
