The Administrator must enforce the chapter’s rules unless another part says someone else should. The Secretary who runs the Coast Guard is solely in charge of enforcement that affects safety of life and property at sea. That Secretary can also handle other vessel enforcement under other laws and may help the Administrator when asked. The Administrator and the Coast Guard Secretary can work together, share people, equipment (including aircraft and ships), and facilities, and they can let other federal agencies help. They may make rules, alone or together, to do their jobs. Officers authorized by the Administrator or the Coast Guard Secretary can board and inspect any covered ocean thermal energy conversion facility, plantship, or vessel; search a vessel with reasonable cause; arrest people subject to section 9151 if there is reasonable cause to believe they broke sections 9151 and 9152(d); seize vessels, gear, or evidence used in violations to prevent evasion; execute warrants; and use other lawful powers. Federal district courts have exclusive original jurisdiction of cases under this chapter, with venue where the action arose or where a defendant is found. For Pacific territories, the proper court is the District of Guam (except American Samoa uses the District of Hawaii). Courts may issue restraining orders, warrants, in rem process, require bonds, and take other actions in the interest of justice. Definitions: “vessel” — includes an ocean thermal energy conversion facility or plantship. “Provisions of this chapter” — includes rules, orders, and license terms under this chapter.
