Existing rights-of-way or rights-of-use that were already given stay in place and are not ended by this law. If the person or company that holds one agrees, the Secretary in charge can cancel it and give a new right-of-way under the rules in this subchapter. If the Secretary issues a new right-of-way for a railroad and its related communication facilities because the railroad is being realigned on federal land, and if it is in the public interest, the land is outside a town or city, and the lands traded are about equal in value, the new right-of-way can keep the same yearly rent, length of time, and type of land interest as the part given up. The Secretary or their delegate must make a final decision on applications under this rule within six months after getting all required information.
