Starting in fiscal year 2012, the Interior Secretary must accept donated valid grazing permits or leases on public lands in the California Desert Conservation Area. For each donated permit or lease, the Secretary must end that permit or lease and make sure grazing on that land stops permanently (except as described below). The land’s forage must be set aside for wildlife use in line with any Habitat Conservation Plan, a section 10(a)(1)(B) permit, or a section 7 consultation under the Endangered Species Act (16 U.S.C. 1531 et seq.). If the donated area is also covered by another valid permit or lease that was not donated, the Secretary must lower the allowed grazing level to reflect the donation and must not allow grazing to exceed the reduced level under the remaining permit or lease.
