Damage to a commercial fishing boat is presumed to be from offshore oil and gas activity if four things are proved. The boat was fishing in an area affected by those activities; a report saying where the object was and what damage happened was filed within 15 days after the boat first returned to port after finding the damage; charts or Notices to Mariners in effect at least 15 days before did not show the object (pipeline damage still counts even if charted); and no proper surface marker or lighted buoy marked or was closely anchored to the object.
