Public land to be irrigated must be taken in plots of 40 to 160 acres. The Secretary of the Interior may allow a smaller minimum than 40 when soil, climate, and market conditions favor fruit or garden crops, and may set farm units of 10 to 160 acres under the Reclamation Act. The Secretary may order subdivision surveys (usually rectangular), record them in BLM books, and pay from the reclamation fund. A claimant may choose a smaller area in any State or Territory.
