Title 43 › Chapter CHAPTER 18— - SURVEY OF PUBLIC LANDS › § 773
If owners of three-fourths of the privately owned land in a township (where more than 50 percent of the land is privately owned) ask for it and put up their share of the estimated cost with the Secretary of the Interior or an officer he names, the Secretary may order a resurvey or retracement of the township lines and set permanent corners and markers under the survey rules. The deposit will pay the survey costs; any money left over will be returned to the depositors in proportion to what each paid. The government’s part for public-land portions will come from the current survey budget. A court can also apply and must provide the deposit. The Secretary may make rules to carry out these steps.
