Title 43 › Chapter CHAPTER 22— - RIGHTS-OF-WAY AND OTHER EASEMENTS IN PUBLIC LANDS › § 940
Grants of right of way and station grounds made before February 25, 1909, under sections 934–939 are cancelled for any part of the railroad that was still unbuilt when the five‑year building period had already ended by that date. Those lands go back to the United States, and people who bought such land earlier get that benefit automatically. If construction was being done in good faith on February 25, 1909, the grant is not changed.
