Lands in Minnesota that the President set aside because they might be flooded for dams, reservoirs, or other work to improve navigation on the Mississippi River and some tributaries are treated as if they were public lands and covered by sections 934 to 939 of this title for all times before February 27, 1901. Any parts of those lands that a railroad got under those sections must always be subject to the right to flood them when the United States needs to build or maintain dams or reservoirs for navigation. Railroads using this must file the maps they were already required to file on February 27, 1901, and also file exact location maps showing the rail elevation with the Secretary of the Army. Railroad lines cannot be placed where they would take, block, flood, or raise the cost of lands needed for reservoir systems existing on February 27, 1901, or for building or extending dams or related works. Plans for any railroad location or construction must be submitted to and approved by the Secretary of the Army and the Chief of Engineers of the U.S. Army before work begins.
